The Federal Motor Carrier Safety Administration (FMCSA) has issued an
important rule severely restricting the use of hand-held mobile communication
devices, such as cell phones, by drivers of commercial motor vehicles. The
new rule, which takes effect on January 3, 2012, is intended to reduce
distracted driving-related crashes involving truck drivers. The new rule
establishes new penalties for drivers and their employers for failure to comply
with these new requirements.
Solid waste companies and others are encouraged to educate their drivers about
this new federal rule, establish and enforce policies regarding cell phone use,
and urge immediate and complete compliance. Companies should encourage
drivers to pull over to the side of the road to make or receive a call on a cell
phone, or to use “hands free” technology such as Bluetooth.
